Your rental includes access to designated trails in Grand County and San Juan County, Utah only. Epic 4X4 Adventures vehicles are not to be operated recklessly, carelessly, or beyond your personal skill level. You are expected to follow all posted trail regulations including trail speed limits, local laws, and our company safety standards.

Utah state law requires all drivers to complete the free Utah OHV Education Course and carry a valid certificate while operating an off-highway vehicle. This applies to both residents and non-residents. Proof of certification is required at check-out.

We maintain our fleet to the highest standard, and we expect the same of your conduct. Damage resulting from abuse, negligence, unauthorized use, restricted area access, or operation beyond your ability may result in full financial responsibility.

The following roads, trails, and obstacles are prohibited due to the significantly increased risk of injury and vehicle damage in these areas. Entering any restricted area or attempting any prohibited obstacle may void all damage protection and coverage limits and may result in termination of your rental agreement.

If you choose to enter restricted areas or attempt prohibited obstacles, additional charges will apply — starting at $500 and increasing based on severity of use and the resulting impact to the vehicle and its components.

These charges account for the increased strain and wear placed on the vehicle, including accelerated belt and tire wear, even when no visible damage is present, and may be assessed in addition to any actual damage-related costs.

If vehicle recovery is required from any restricted area or obstacle, recovery fees start at $2,000. Epic 4X4 Adventures is not a recovery service, and third-party recovery in Moab — particularly in remote and technical terrain — can be complex and costly.

All vehicles are equipped with GPS tracking, which may be used to verify trail access. These restrictions are in place to help protect your safety, preserve your experience, and support responsible recreation on Moab's trails.

All rental vehicles are GPS-tracked. We reserve the right to monitor your location, driving behavior, and speed.

Tampering with, disabling, or attempting to interfere with the tracking system will result in immediate termination of your rental without refund, forfeiture of your deposit, and possible legal action.

Our UTVs are equipped with sensitive mechanical and electrical systems, and improper water exposure — such as high-pressure washing — can cause damage. For this reason, we ask that you do not wash or rinse the vehicle during your rental. Cleaning is included as part of your experience.

Our standard cleaning covers normal use, including typical dust and conditions related to weather. However, excessive mud inside the vehicle, on the roof, or heavy exterior buildup may result in a cleaning fee starting at $250.

To help protect your experience and avoid unnecessary issues, we recommend:

• Passing slowly and cautiously through water or mud only when necessary
• Avoiding recreational driving in water, sand, or mud areas
• Operating the vehicle in a controlled and responsible manner at all times

Moab's terrain is uniquely demanding, and simple, careful operation goes a long way in keeping your ride smooth, safe, and trouble-free.

We are committed to handling all charges with fairness, professionalism, and transparency. If your vehicle is returned damaged or in violation of these Terms & Conditions, you will receive a detailed explanation, before-and-after photos when available, supporting documentation, and an itemized invoice or charge summary.

By agreeing to these Terms & Conditions, you authorize all charges related to your rental, including but not limited to damage or loss, administrative fees, shop fees, trail violation fees, vehicle recovery costs, cleaning charges, towing, extraction, transport, and loss-of-use charges.

If a dispute is initiated with your credit card issuer before contacting us directly, the matter will be referred to legal counsel along with all supporting documentation.

Based on legal guidance, we may pursue formal action in the State of Utah if necessary. The prevailing party will be entitled to recover attorney's fees, court costs, and any applicable collection expenses. We strongly prefer to resolve any concerns directly and professionally, and doing so ensures the most fair and efficient outcome for everyone involved.

By taking possession of the vehicle(s), you agree to operate them in a safe, respectful, and responsible manner, consistent with company policies, Tread Lightly principles, and all local laws. The following standards apply to all renters and drivers:

• No racing or contests of speed or performance
• Navigation tools, maps, GPS systems, suggested routes, and visual indicators (including "Red Zones" or restricted area overlays) are provided for convenience only and are not a guarantee of safety, suitability, or successful navigation. These tools may not display accurately or consistently and are not guaranteed to function at all times. Trail conditions, obstacles, and risks can change at any time.
  
  Lack of visibility, delayed updates, GPS inaccuracy, or loss of cellular or satellite signal does not relieve renter of responsibility. Renter is solely responsible for knowing their location at all times, selecting appropriate routes, assessing terrain, and making all driving decisions.
  
  Renter assumes full responsibility for any damage, incident, or injury resulting from navigation choices or entering restricted areas, regardless of whether such areas are visibly marked within any navigation tool.
• Avoid recreational driving in water, sand, or mud areas. Pass through these conditions slowly and only when necessary
• Operate within your current skill level. Moab's terrain is uniquely demanding — know your limits before you go
• Remain on designated OHV trails at all times
• Obey all posted signs and trail regulations. Typical trail speeds range from 15–25 MPH, though lower speeds are often appropriate depending on conditions
• UTVs are street legal only for accessing trailheads. Driving around town is not permitted
• Overnight rentals must be parked by 10:00 PM
• No towing or being towed
• Do not alter or tamper with the vehicle

Prohibited Conduct — Zero Tolerance

The following actions are strictly prohibited and will result in immediate termination of the rental and full financial responsibility for all resulting costs, as outlined in these Terms & Conditions.

• Operation of the vehicle under the influence of alcohol, drugs, or any impairing substance
• Presence of open containers of alcohol in or around the vehicle during the rental period
• Intentional misuse or operation of the vehicle in a manner clearly inconsistent with normal recreational use
• Use of the vehicle in restricted areas or prohibited obstacles as outlined in these Terms

If prohibited conduct is identified, any damage protection, coverage limitations, or deposit protections may be rendered void or inapplicable, and renter will be responsible for all resulting costs without limitation, regardless of any protection selected.

Evidence may include GPS tracking data, vehicle telemetry, inspection findings, photographs, and staff observations.

Recreate responsibly. These simple practices help protect your safety, preserve Moab's trails, and support a smooth, trouble-free experience from start to finish.

A $3,000 damage deposit authorization is required per vehicle at the time of check-in. This authorization protects against damage, misuse, or violations of the rental agreement during your rental period.

The individual providing the deposit assumes full financial responsibility for the vehicle, regardless of who is operating it at the time of any incident.

Premier Adventure Assure (Optional Upgrade)

Guests may elect to purchase Premier Adventure Assure, which:

• Reduces the maximum out-of-pocket responsibility to $1,500 + recovery costs, and
• Waives the damage deposit requirement for guests with a valid U.S. driver's license.

Guests with international driver's licenses are eligible to purchase Premier Adventure Assure to reduce financial exposure; however, a damage deposit authorization is still required in these cases.

Multiple Deposits

Upon request, separate deposits may be taken for individual drivers. Each authorization must be for the full $3,000 amount and cannot be divided or shared.

All deposits are held for up to 48 hours following the conclusion of your rental to allow for vehicle inspection and GPS review. If no damage or violations are identified, the authorization will be released within that timeframe.

Vehicle Recovery & Retrieval

Renter acknowledges that off-road vehicle use involves inherent risks, including the potential for immobilization or required recovery.

If a vehicle becomes disabled, stuck, inoperable, abandoned, or otherwise unable to be returned under its own power, vehicle recovery will be required.

Recovery includes, but is not limited to, towing, extraction, winching, off-trail retrieval, transport, dispatch time, labor, coordination, and any third-party recovery services required to return the vehicle.

Recovery Responsibility

Vehicle recovery is required any time a vehicle cannot be safely returned under its own power, regardless of cause. Recovery is not covered under any damage waiver, protection plan, or insurance selection and will be charged separately.

Renter is responsible for the full cost of any recovery required during the rental period, including but not limited to:

• Towing
• Extraction and winching
• Off-trail retrieval
• Transport
• Labor and coordination
• Third-party recovery services
• Specialized recovery equipment
• Extended labor and time

Recovery required solely due to mechanical failure not caused by the renter will not be the renter's responsibility.

Recovery timelines are dependent on terrain, safety conditions, weather, and resource availability. Immediate recovery is not guaranteed.

If the renter operates the vehicle in violation of the Polaris Product Rental Agreement or these Terms & Conditions, renter agrees to be fully responsible for all resulting costs associated with that use.

This includes all costs incurred by Epic 4X4 Adventures in connection with the incident, regardless of any coverage, protection plan, or reimbursement that may apply elsewhere.

These costs may include, but are not limited to:

• Vehicle recovery and transportation
• Administrative time and coordination
• Inspection, diagnostics, and service handling
• Fleet management and operational handling required to return the vehicle to service
• Loss of use, including lost rental revenue for the period the vehicle is unavailable due to damage or renter conduct that results in the vehicle being removed from service

These charges are separate from and not limited by any damage waiver, protection plan, deposit amount, or standard coverage limitations.

By signing this agreement, you:

• Acknowledge these Terms & Conditions supplement Polaris Adventures documentation
• Accept full financial and legal responsibility for the vehicle and your actions
• Understand violations may result in penalties, termination, voided protection, or legal action
• Authorize charges resulting from damage, misuse, recovery, violation of these Terms & Conditions, or other amounts due under your rental
